She loses her job due to statements she posted on Facebook

A patient care attendant was dismissed for posting derogatory, offensive and disrespectful statements about her employer on her Facebook page. She disagreed with the latter’s decision to assign her to light work during her pregnancy. Instead of discussing the matter with the employer or providing him with a new medical certificate, she chose instead to “pick on” the hospital through her Facebook page, with links to 229 friends, most of whom were co-workers and people working in the health care network. She did it again a few days later, thus showing that this was not a spur-of-the-moment impulse. Her statements were such that they could not have a positive impact on the job atmosphere, nor could they be of any help in staff recruitment. The arbitrator confirmed that the employer was right to conclude that the bond of trust had been severed. The dismissal of the employee, who had only 18 months’ seniority, was upheld.
