DRUG USE: APPLICATION OF ZERO-TOLERANCE POLICY

Six employees working in a factory were dismissed for having used marijuana in the workplace during break and meal times. All of the complainants admitted they used cannabis at work, and were fully aware that they were violating a clear policy from the employer that prohibited all drug use in the workplace. According to the arbitrator, the zero-tolerance policy – of which the employees were aware – relieved the employer of the obligation to issue warnings before dismissing employees, particularly as the consumption of cannabis is a criminal offence.
