ABSENCES FOR TREATMENTS FOLLOWING A WORK ACCIDENT MAY BE MONITORED

An employee alleged that the employer unlawfully reduced his salary during a temporary assignment. The employer justified the reduction by citing its policy stipulating that the employee’s attendance at each treatment as well as their duration must be confirmed in writing by the consulted health professional. In the event that the employee fails to comply with this policy, the employer pays two hours for each absence, whereas it pays the employee’s salary for the duration of the treatment in addition to one hour of traveling time when the policy is followed. This consistent policy is reasonable and does not violate the law, since an absence must be justified. The physician’s indication that regular work was permitted in the mornings and that the physiotherapy treatments should be scheduled in the afternoons did not exempt the worker from returning to work after his treatments.
