THE INSTALLATION OF CAMERAS TO MEET C-TPAT REQUIREMENTS WAS REASONABLE
The union challenges the installation of cameras inside the factory, alleging that this amounted to unreasonable working conditions, among other things. The employer installed these cameras in order to secure American C TPAT accreditation, a system under which only accredited companies may pass their cargo through customs without formalities, thus reducing delays. C-TPAT inspectors had come twice to the factory to ensure that cameras would be set up to monitor people entering the factory. Though the arbitrator reiterated that third party requirements, in this case C-TPAT inspectors, cannot justify imposing unreasonable working conditions, he deemed that setting up cameras in this case was reasonable, since their position was in line with case law criteria, among which as the fact that they were not stationary over any given worker.
