She resisted the new director's instructions, but was not subjected to psychological harassment

A sales representative in the mining sector alleges that she suffered harassment and was dismissed without just and sufficient cause. She complains that the new director made remarks concerning her performance and business attire, sent her curtly worded written communications and changed some work instructions. According to the C.R.T., the alleged situations reported by the employee relate to the supervisor/subordinate relationship that places her under the authority of her supervisor. The latter set management expectations that proved legitimate and consistent with his rights. In addition, the director’s remarks, even though they were curt in tone, do not constitute vexatious conduct. In fact, the employee is showing strong resistance to her director’s new instructions and challenges his authority. As regards her dismissal complaint, it is rejected, since the evidence revealed that the employee’s position was abolished due to restructuring. Turgeon v.
