The employer was right to manage a situation as a personality conflict, rather than as a case of psychological harassment

Release date: August 9, 2009

An audiovisual laboratory technician alleges that he was harassed by an instructor in his department with whom he was at one time on friendly terms. He takes exception to the latter’s orders, verbal disapproval regarding the quality of his work, fits of anger, etc. Evidence revealed that the instructor addressed the employee using cavalier and authoritarian language. However, once informed of the problem, the employer took measures to have him understand that he was expected to change the manner of his interaction with the employee. In addition to these meetings, the instructor was suspended. According to the arbitrator, the employer was right to manage the situation not as a situation involving harassment, but rather as a conflict between co-workers. The grievance was therefore rejected.
