One Sudoku too many

A technical advisor in charge of maintaining the computer network in good order, with 4 years of service, challenges his dismissal. The employer contends that he deliberately and repeatedly used the Internet for personal purposes, having browsed the Net for 21 hours over a period of 11 working days. On several occasions, the employee had been advised to comply with the regulations for Internet use and, the day before his dismissal, he was warned to stop using the Internet for personal purposes. The very next morning he was caught playing Sudoku. According to the arbitrator, dismissing the employee under such circumstances was not in violation of the principle of graduated sanctions, as this repeat offence severed the bond of trust.
