THE FUTURE EMPLOYEE HAS TO PAY $7,500 FOR QUITTING BEFORE EVEN STARTING THE JOB

An employer filed suit for damages against an employee he had just hired.

The employee, a few days before the date set for him to take up his job, advised the prospective employer that he would not be coming to work, preferring to keep his job with his present employer, who had offered him working conditions that were much more advantageous. According to the Court, this employee demonstrated unacceptable recklessness and a lack of concern regarding his new employer by refusing at the last minute to comply with his contract. In terms of aggravating factors, the Court particularly considered the fact that the job offered was a key position, and that the employer had been staking a great deal on the experience and knowledge of this employee. The Court therefore sentenced him to pay $7,500 in damages to the new employer, which was the equivalent of 6 weeks' notice, plus $1,000 to cover his hiring expenses.
