SUPERVISOR’S INAPPROPRIATE BEHAVIOUR MIGHT NOT CONSTITUTE HARASSMENT
A nurse alleges she was a victim of psychological harassment perpetrated by the head nurse. She says she criticized her in front of others, said hurtful things, used a harsh tone, lifted her chin to make her listen, etc. According to the arbitrator, even if the supervisor did not always act appropriately, she did not harass the employee. Though raising one’s voice and speaking to the employee in front of others was not the best approach, she cannot be deemed to have conducted herself in a vexatious manner that was harmful to the employee’s dignity. While making insinuations as to her mental capacity may have been hurtful, it does not constitute harassment. Lastly, even though lifting her chin was inappropriate, it did not adversely affect the employee’s dignity. The grievance was dismissed.
