A director alleges to have been dismissed without just and sufficient cause. The employer accuses him of behaving in a way that created an ongoing atmosphere of seduction towards a young coordinator over whom he had no authority, while attending a trade show in Las Vegas (sending multiple inappropriate text messages, repeated invitations, leering glances, unwanted touching, etc.), despite the fact that the coordinator asked him several times to stop his unwanted behaviour. The tribunal concluded that the complainant had engaged in unacceptable behaviour that meets the definition of sexual violence. The complainant committed a serious fault and was unlikely to improve, which justified the employer to disregard the principle of progressive discipline. The lack of remorse and the complainant’s tendency to try to blame the coordinator are not only aggravating factors but also demonstrate his inability to change. The dismissal is upheld.
