Placed under quarantine by his own doing and therefore not entitled to any remuneration
Release date: August 6, 2021
The employer found out that the employee was seeing his brother in person, after the latter had placed himself in isolation upon returning from a cruise. The employer sent the employee home with instructions to self-quarantine. The union argued that the employee should be paid during his absence and claimed 37 hours of pay. Since the employee had told the employer that he intended to continue to see his brother despite the quarantine, the employer had the right to deny him access to the company premises for preventive occupational health and safety reasons. The employer judiciously exercised his discretion in not paying the employee for unworked hours during quarantine. The employer’s decision was not arbitrary, discriminatory or abusive and was not in violation of the collective agreement. The grievance was dismissed.
