Even on temporary assignment, she couldn't manage her schedule

A cabinetmaker has filed a complaint under section 32 of the AIAOD. She was dismissed because of her numerous late arrivals and absences during a temporary assignment and progressive return to work. The employee justifies her lateness by the obligation to take her children to school in the morning. She alleges that she can manage her work schedule since she is on light work and that her lateness has no effect on her work performance, to which the employer responds that it cannot create inequity towards other employees. Despite the imposition of several disciplinary measures and the fact that she had been warned that the next lateness or absence would result in a dismissal, the employee still refused to respect the established schedule. The decision-maker pointed out that the employer retains his management rights, despite the presence of an employment injury or a progressive return to work. The complaint is dismissed.
