Surveillance cameras must be removed

The union is contesting the presence of surveillance cameras inside the employer’s new warehouse. These fixed cameras operate continuously, filming employees as they carry out their duties. The employer claims that the warehouse’s high level of danger justifies protecting the premises against theft or intrusion. According to the Court, the new warehouse hardly qualifies as a dangerous workplace: there are no explosives or hazardous materials. In addition, there was no evidence of any real and urgent issues regarding occupational health and safety or theft. What’s more, less invasive security measures outside the warehouse are enough to protect the interior. Given that the employer failed to prove the existence of increased security risks, the installation of the cameras therefore infringes the employees’ right to privacy, as they do not benefit from just and reasonable working conditions. The grievance is upheld, and the removal of the cameras is ordered.
