A control center assistant was dismissed during his period of disability due to his failure to respond to three formal convocations requiring him to report to work or provide more detailed medical information to justify his absence and his request for accommodation. At the time of dismissal, the employee had been on disability leave for six months. The evidence revealed that during this period, the employee was working as a server in his restaurant. He did not cooperate with his employer and did not provide details about the reasons for his absence or his state of health. He remained evasive or refused to provide the requested information. By remaining silent in response to the employer’s requests, the employee failed to engage in any attempt to initiate an accommodation process, and the employer was justified in concluding that he refused to work. Termination of employment was the only option under the circumstances. The grievance is dismissed.
